Definitions

References to ‘you’ and ‘yours’ are references to the Individual completing the application form.

‘Membership Card’ means the card issued to a Member by Cardiff Council to allow a Member to use the Centre.

‘Application Form’ means the [attached form] signed by an individual entering into an agreement to use Cardiff Council’s Channel View Centre CF11 Fitness Membership.

‘Cardiff Council’ means The County Council of the City and County of Cardiff.

‘Centre’ means Channel View Centre

‘Member’ means an individual entering into an agreement with Cardiff Council to use the CF11 Fitness Membership

‘Membership Fee’ means the fee payable under the CF11 Fitness Membership as detailed on the Application Form

Principle Terms

1) This agreement commences and therefore becomes binding on the date that both parties sign the Application Form.

2) This agreement is not transferable and all applicants agree to have their photograph taken as a security measure to prevent fraudulent use. Photographs will be linked to your card and stored electronically for identification purposes.

3) The CF11 Fitness Card can only be used in the Centre.

Fees and Charges

4) You are signing an agreement to use the Centre on a monthly basis.

5) The monthly Membership Fee must be paid by Direct Debit and this will be taken from your bank account on the 15th day of every month unless the 15th falls on a weekend or bank holiday, in this case the Membership Fee will be taken from your bank account on the next working day. Cardiff

Council reserves the right to change this date upon ten days written notice.

6) You agree to advise us immediately of any change to your details on the Application Form.

7) Cardiff Council reserves the right to review all charges at any time.

Cancellation and Termination

8) Your membership will automatically continue on a month-by-month rolling renewal at the amount currently advertised on the CF11 Fitness website per month, until such time as you provide Cardiff Council with one month’s written notice of your intention to cancel (minimum one Direct Debit payment) to CHANNEL VIEW CENTRE, JIM DRISCOLL WAY, GRANGETOWN, CARDIFF, CF11 7HB

9) This agreement can be terminated by Cardiff Council on providing you with one month’s written notice.

10) Cardiff Council reserves the right to cancel or withdraw membership with immediate effect in exceptional circumstances without compensation.

By signing this agreement you warrant, declare and acknowledge that:

11) The information provided on the application form is correct.

12) You are in good health and not knowingly incapable of engaging in exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing, or physical condition. You will advise us immediately should circumstances change.

1) You are required to complete an induction at Channel View Centre with a suitably qualified member of Cardiff Council prior to using the gym. Unless you have signed a disclaimer form.

2) You will not:

(a) risk the health and safety of Cardiff Council staff and other Members.

(b) engage in disruptive or violent behaviour

(c) behave in a way that is a security or safety hazard to yourself or others

(d) abuse equipment or facilities

(e) abuse staff verbally or physically

3) You will:

(a) use the gym equipment and facilities in accordance with all usage instructions

(b) conduct yourself in such a manner so as not to interfere with other Members use or enjoyment of the equipment and facilities

(c) wear appropriate clothing and footwear to use the facilities

4) Cardiff Council will not be liable in any way for the loss of or damage to or theft of your property or for personal injury to or death of any Members or individuals using the Centre except to the extent that such a loss, damage or personal injury or death arises from Cardiff Council’s wilful act, negligence or default.

5) You have read this agreement including the terms and conditions before signing it.

6) Cardiff Council reserves the right to vary these terms and conditions from time to time, you will be notified in advance of any changes and the changes will be available to view on CF11 Fitness website and on notice boards within the Centre.

COOLING OFF PERIOD – from the date of signing the agreement you have the option of a 14 day cooling off period during which time you may cancel this membership.
